2 vehicles travelling the same direction - 1 is in the left lane, the other in the right lane. Left lane spins?
2 vehicles traveling the same direction - 1 is in the left lane, the other in the right lane. Left lane spins, crossing into the right lane. Right lane driver tries to avoid by moving to the left lane to go around. 1st vehicle strikes the bridge wall and re-enters the left lane striking the 2nd drivers vehicle. 1st driver loses wheel assembly on drivers side of vehicle and comes to race facing on coming traffic- 2nd driver comes to rest in the median of the divided highway - Who would you say had liability?
The cause of this accident was the first driver's loss of control of his vehicle. The avoidance maneuver by the second driver did not cause the accident.
"Failure to maintain control of vehicle" is reason to write a ticket, and assign liability.
I've seen this kind of spinout on a multi-lane road - twice. (The rest of the accident was different than your example, of course.) The first time, it was a pickup truck driver who obviously didn't respect a snow covered road, and was driving way too fast for conditions. The second time, a van driver hydroplaned on a wet road. He probably had bald tires.
